Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 300 Club Scheduling app and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. The Service is intended for adult members of a Torah learning community and their organizers, and is offered only to users located in the United States.
2. Accounts
To use the Service, you must create an account by signing in with Apple, Google, or another supported method. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Provide accurate information, and update it if it changes.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts.
- Reverse engineer, decompile, or otherwise attempt to extract source code, except where such restrictions are prohibited by law.
- Use the Service to harass, threaten, or impersonate others.
- Upload or transmit content that infringes another party's rights or that you do not have the right to share.
4. Notifications
The Service sends push notifications for scheduled calls, snag invites, and related events. By enabling notifications, you consent to receive them on your device. You may disable notifications in your device settings, but doing so may reduce the usefulness of the Service.
5. Program Content
Slot assignments, member rosters, notes, and check-off state are entered by the Rabbi and members of the program. You are responsible for the accuracy of any information you enter. The Service is a coordination tool and does not guarantee that any specific call will take place.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it.
7. Intellectual Property
The Service, including its software, design, and content (excluding user-provided content), is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.
You retain ownership of any content you submit. By submitting content, you grant us a worldwide, royalty-free license to host, store, and display that content solely to operate and provide the Service.
8. Third-Party Services
The Service relies on third-party providers, including Supabase, Vercel, Expo, Apple, and Google. Your use of features that depend on these providers is also subject to their terms. We are not responsible for the availability or actions of third-party services.
9. Termination
You may stop using the Service at any time and may permanently delete your account from inside the App (Profile or Settings → Delete account) or by contacting us. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends immediately.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
13. Changes to the Service or Terms
We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes to the Terms, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, unless otherwise required by applicable law.
